



The State of Florida charges individuals up to $1 per page for copies of their medical records. One dollar per page to copy your medical records may seem like a nominal charge for an individual who is healthy and only sees their doctor during their yearly well visit, but what if you're a disabled individual whose condition requires you to frequents your doctor, specialist, and/or hospital once a month? Your medical records will add up fast.
Now let's add a few more ingredients to the mix: What if you're disabled, unemployed, uninsured, and filing for disability benefits from the Social Security Administration or Veterans' Administration? How will you pay for the medical evidence you are required to provide to support your claim?
A change in the statute is required by the legislature. Our law firm is petitioning that the statute include the following:
NO PROVIDER SHALL CHARGE FOR FURNISHING A HEALTH RECORD TO A PATIENT, HIS ATTORNEY OR AUTHORIZED REPRESENTATIVE IF THE RECORD IS REQUESTED FOR THE PURPOSE OF SUPPORTING A CLAIM OR APPEAL UNDER ANY PROVISION OF THE DEPARTMENT OF VETERANS AFFAIRS OR SOCIAL SECURITY ACT, ONLY IF THE REQUEST IS ACCOMPANIED BY A COPY OF THE CLAIM OR APPEAL DOCUMENT. RECORDS MUST BE PROVIDED WITHIN 30 DAYS FROM THE WRITTEN REQUEST.
