Choose the Correct Work Status and Avoid Disability Errors


A recent fraud case illustrates the importance of choosing the correct work status when filing for Social Security disability benefits. The case arose when it was discovered that a 56-year-old New Jersey woman was being paid about $17,000 in Social Security disability that she was not entitled to.

The excess payments occurred because the woman lied to the SSA about her work status while she received disability payments.

According to New Jersey On-Line, the woman was approved for disability benefits when she said that her back injury prohibited her from working. However, she was employed at a local restaurant owned by her family.

She may have been eligible to receive benefits if she had either informed the SSA of her desire to work part-time, or used the Ticket to Work program.

This case is an example of the type of critical error that can occur when an individual doesn't disclose important information to the SSA, or has confusion about what they are or are not permitted to do when claiming disability status.

This woman's omission is considered fraud, and carries the possibility of up to six months of imprisonment. The punishment is subject to change depending on the federal judge who oversees the case.
