According to an article in The LA Times, the full 9th Circuit Court of Appeals has decided to withdraw its ruling regarding the Department of Veterans Affairs (VA), which demanded the VA to reform its health care system and how it treats veterans with disabilities.
The court's decision had come from a lawsuit that was filed 4 years ago alleging "systematic failure" on the VA's part to properly treat veterans with psychological injuries. The VA's inactions lead to a high suicide rate among veterans, which resulted in about 6,500 veterans taking their own lives every year.
The dissent in the original ruling stated as outrageous as the VA's inattention to treatment of veterans with post-traumatic stress disorder was, it wasn't the role of the court to "step in and boss [the VA] around."
One of the VA's appellate contentions in its request for the court to review its original decision in this case was that there was no due process owed veterans under the Constitution that would entitle them to "efficient handling of their treatment and benefit claims."
Should that be found to be true, it would present a threat to every veteran and their families attempting to collect benefits for medical care, education, burial and death, and service-related disabilities.
