The veterans disability system available via the Department of Veterans Affairs (VA) benefits can be confusing and intimidating, and unfortunately, there are some who take advantage of this fact in order to bilk veterans out of money.
Charging veterans to help them file their initial VA disability claims is illegal under federal law. Further, any company claiming to help veterans in such a way must be accredited by the VA.
Unfortunately, Congress at one point removed all criminal penalties associated with this law, resulting in an uptick of perpetuators. A new law should close that loophole, according to an article in ABC Action News.
U.S. Rep Gus Bilirakis (R-FL) sponsored a new bill (HR 1826) reinstating criminal penalties for charging veterans for that initial help. If passed, violators could face up to 12 months in jail and fines. The House Committee on Veterans' Affairs has already approved the bill, which will be voted upon by the full house sometime in October.
This controversy highlights why it is so vital for disabled veterans to be very cautious in whom they choose to work with in the fight for disability benefits. Investigate the company's history and ask for detailed payment methods. If the company asks for money up front - before you have even applied for or qualified for benefits - or they are evasive in answering your questions about payment requirements, it is in your best interest to cease working with that company immediately.
