The Department of Veterans Affairs (VA) has been put under congressional pressure to find the best way in which to process veterans disability claims from those claiming trauma related to military sexual assault (MSA) or rapes while in service, according to an article in The Army Times.
One of the main issues the VA must address is handling claims almost devoid of evidence because MSA is so underreported. As a solution, the VA is attempting to progress the disability claims process specifically for victims of MSA. At the same time, the VA can begin providing counseling for those veterans who are victims of MSA and who either don't have a disability rating or aren't planning on applying for one.
Considering the underreported MSA and rapes, the Veterans Benefits Administration (VBA) has begun development on "training emphasizing the liberal evidentiary standards that are used in rating MST (military sexual trauma) claims."
Many lawmakers feel current standards make it entirely too difficult to prove MSA claims. The problem lies in the level of the evidence veterans must gather to prove they suffer from post-traumatic stress disorder (PTSD) formed out of a sexual assault while in the military.
Along with a possible change in the regulations for proving an MSA disability claim, the VA is currently developing a training program for doctors performing disability compensation examinations for veterans making MSA disability claims.
