Presumptive Illness Standard for Agent Orange Cases is Under Threat


U.S. Sen. Tom Coburn (R-Ok.) has made a proposal to the 2012 Military Construction Appropriations (MilCon/VA) Bill that may very well end up undoing years of positive work, and end up denying benefits to 1000s of veterans. The MilCon/VA bill controls the spending for both the Department of Veterans Affairs (VA) and military construction.

Coburn's proposal would directly affect those veterans exposed to toxins such as Agent Orange. The VA currently uses a "positive association" to connect veterans' health problems and being exposed to deadly toxins. If Sen. Coburn has his way, the VA would be forced to start requiring proof of a "causal relationship" between the health issues and the exposure.

Under Sen. Coburn's proposal, veterans claiming they have health conditions due to their exposure to these toxins would be required to prove a direct connection. This proposal will essentially undo the presumption standard currently used to determine disability in veterans.

The Agent Orange Act of 1991 originally established health benefits for veterans exposed to toxins during their military service. Just last year VA. Sec. Eric Shinseki added t3 more health disorders to the list of presumed health conditions caused by the exposure. Sen. Coburn's proposal would likely not only affect Vietnam veterans, but more recent veterans as well.
