Return Social Security Checks After Recipient's Passing

If you are caring for someone who receives Social Security payments, whether Supplemental Security Income, Social Security disability, or some other benefit, you may have questions about the process. Specifically, many do not know what to do in regards to checks in the event of their loved one's passing away.

They often wonder if they should notify the SSA right away, or if they can continue collecting checks for a few more months if they need the money for funeral expenses. The answers from the SSA are quite clear, and should be heeded to avoid having to pay back the funds unexpectedly.

In most cases, the funeral home will notify the SSA of the passing of the recipient. However, to make sure everything is updated, you can also contact the organization. Otherwise, you could forget about it until you see check after check piling up in the mail, and wonder what to do with them.

The checks should be returned as soon as possible, with a follow-up call to the SSA as a reminder not to send any more. If the money was being deposited directly into your relative's account, you should also notify the bank involved about the situation.

You might have some funeral expenses that you or other family members paid out of pocket, and wonder if you will get compensated for that. Times are tough, and this concern is understandable. If you are the surviving spouse, or one of the deceased's children if there is no surviving spouse, you should receive a one-time lump sum death benefit. This is a check for $255. You may also qualify for survivors' benefits.

When the mistake is the SSA's, it may be tempting to keep checks intended for your deceased relative, even if just to cover funeral costs. However, there are often harsh consequences if caught. If you have any questions or want more information about death benefit payments, contact an experienced lawyer

If you, or your loved one, are suffering from a severe physical or mental disability, you should contact a Social Security Disability lawyer immediately to learn about your rights and determine eligibility.
