Social Security Disability Medical Reviews

Did you know that if you receive Social Security disability benefits, the government will establish a schedule to routinely review your medical case to verify that you still qualify for disability benefits?

The reviews are intended to ensure that all individuals receiving the disability benefits are truly unable to work because of their injuries. Unless the reviewer can find strong evidence that your medical condition no longer prevents you from seeking employment, you should never experience a lapse or cancellation of your benefits.

The frequency of the medical reviews depends on the severity and nature of the disabling injury or condition. If your doctor has indicated that a medical improvement is likely, you should expect a review within six to 18 months from the time you begin receiving Social Security disability benefits.

If your medical team indicated that a medical improvement is possible, expect a review of your disability case every three years or so.

If the severity of your disability is such that no improvement is expected - for instance, paralysis from a complete spinal cord injury - you should expect a medical review every five to seven years.

Your Social Security disability benefits award letter should tell you when you will have your first review. You should also receive formal notification of all subsequent medical reviews and information about your right to appeal the medical evaluation.

When you are interviewing Social Security Disability attorneys ask critical questions, like: how many Social Security Disability hearings do you have per month; do you understand the SSA's POMS (the manual Social Security employees use to process claims); and, do you understand the date last insured and how it affects my disability onset date? The Law Offices of LaVan & Neidenberg P.A. represent thousands of disability claimants. Our disability lawyers possess the experience you need to secure your benefits.
