The 4 Stages of a Social Security Disability Benefits Appeal

When you are filing for an appeal on a decision made regarding your Social Security disability benefits you may need to go through 4 stages of appeals.

Reconsideration
is the first level of appeal where your claim will be reviewed by a Social Security Administration (SSA) official who did not take part in the initial benefits claim review. Your Ft. Lauderdale disability lawyer will help you provide additional evidence for your claim if the original application was lacking in support.

If the reconsideration is also denied, you may request a hearing by an administrative law judge. In most situations you will need to be physically present at the hearing, unless the court determines you may attend through video conference. You may bring witnesses to support your claim and your Ft. Lauderdale disability lawyer will also be present to assist in the hearing.

If you disagree with the decision of the hearing, you will then file for an appeal with the SSA's Appeals Council. The Appeals Council will review your hearing decision but may deny a request for review if they agree with the administrative law judge. If the Appeals Council does accept your review, they will conduct it themselves or return it to the administrative law judge for reconsideration.

The final stage of appeal is with the Federal Court. You will benefit greatly from having a Ft. Lauderdale disability lawyer assisting you in filing a lawsuit with the federal district court. This is the last option you have to fight for your benefits decision and should not be handled without professional assistance from a lawyer.

Appealing a decision made regarding your Social Security disability benefits is a difficult legal process which should not be done alone. You have the right to the assistance of an experienced Ft. Lauderdale disability lawyer in these cases. Your lawyer will be able to help you provide better evidence and witnesses to prove your need for Social Security disability benefits.

I'm always amazed at how often people are hesitant to contact an attorney because they think it'll be too expensive. In reality, hiring an experienced Social Security attorney will put money directly into your bank account! You are doing a great service for people in Florida with the information on this blog. We just launched our blog for the Dallas area and continue to look to your site here as an inspiration. Kudos on a job well done.
