The Role of a Vocational Expert in a Social Security Disability Hearing

If you suffer from a severe mental or physical disability and you are unable to work-otherwise known as engaging in Substantial Gainful Activity (SGA)-you may qualify for disability benefits under the Social Security Administration.

Claimants who apply for Social Security disability benefits may find their claims denied, resulting in the need for an appeal. Part of the appeals process includes a hearing where a Vocational Expert might be called upon.

A Vocational Expert is an expert in anything related to vocation or occupation. They will provide information to the judge about what types of jobs are available for someone who suffers from your specific disability and resultant limitations.

Keep in mind that in order to receive Social Security disability benefits, you must be able to prove that you are unable to work or engage in SGA. This is why a Social Security disability attorney can be very helpful in preparing your case. They will ensure that all the limitations of your disability are covered during your appeal.

A Vocational Expert will give their expertise in many areas which may include:

  • Earnings potential;
  • The existence and availability of physically undemanding jobs in the national economy; and
  • Rehabilitation.

The judge will often use your medical history to pose hypothetical situations to the Vocational Expert-for instance, that you can't sit or stand for longer than 1 hour without experiencing pain-who in turn will try to determine if there are jobs available in the national economy that match your abilities.

By law, a Vocational Expert must be impartial and objective in their findings. This can benefit you in a Social Security disability hearing if you and your Social Security disability attorney are able to assemble a convincing body of medical evidence to support your claim of disability.

Nothing can replace the expertise you can get from a qualified and experienced Social Security disability attorney. Contact a disability attorney who can help you throughout the entire process.
