In a report from Health News, tobacco companies are filing a lawsuit over the U.S. Food and Drug Administration's (FDA) graphic warning label requirements. Starting in September 2012, the FDA has mandated that graphic images depicting the consequences of smoking be placed on cigarette packs. However some tobacco companies are fighting back.
Specifically, the requirements are that the images be placed on the top 50% of the front and rear panels. The idea is to illustrate the serious consequences of smoking so that fewer people start the habit and those already smoking are motivated to quit.
Tobacco companies are alleging that these requirements infringe on their First Amendment rights. The belief is that boundaries are being overstepped.
