VA Owes $1000s For Cape Coral Clinic According To Contractor


One of the contractors working on the new Department of Veterans Affairs (VA) Cape Coral Medical Clinic is making some serious accusations against the VA. Not only is he claiming the VA owes him $62,000 for overages, but the disabled veteran minority business owner is also claiming his business was discriminated against during construction.

Ernesto Lamar owns Lamar and Associates. The VA continually denied his payment requests, and he has since turned the matter over to a collection agency. According to the VA, they rightfully denied the cost overages Lamar is attempting to collect. Had his business been "treated fairly," however, Lamar claims the overages would not have happened.

Lamar and Associates are under a 2 year contract worth $260,000. They work as the Special Inspections and Construction Materials testing firm on site. According to Lamar, VA project liaisons caused the overages.

Apparently those liaisons continued to take issue with Lamar's project manager. Lamar's presence was continuously required on-site in order to repair issues he claims were not broken, despite liaisons finding issues.

Eventually the VA replaced Lamar's project manager with their own project managers, who were less qualified and less experienced than Lamar's people, according to Lamar. At that time, the VA was no longer communicating with anyone in Lamar's organization. Lamar is worried about his future ability to bid on VA contracts.

The VA did not pay the overages because those overages were not part of the included contract prices. The awarded contract was for a fixed price, and the VA plans on paying the contract price.

The VA will not speak as to why Lamar incurred additional costs, but they did complete an investigation into his claims. Lamar denies the validity of the VA's investigation, and continues to claim the VA has problems "working with minorities or people of color."
