VA Sued For Wrongful Death of Iraq Vet In Federal Court


According to a lawsuit recently filed against a Department of Veterans Affairs (VA) medical center, a VA hospital staff in Utah caused the wrongful death of Chris Anglesey, an Iraq War Veteran. According to the suit, the veteran's wife brought the malpractice lawsuit after the VA staff administered what turned out to be a deadly combination of drugs because they failed to familiarize themselves with the drugs already in his system.

The complaint names multiple doctors as well as the George E. Whalen VA Hospital in Salt Lake City, Utah as defendants. He was granted partial permanent disability following his service in Iraq where he was riding in a vehicle that was struck by a rocket-propelled grenade. Anglesey eventually suffered post-traumatic stress disorder (PTSD) as well as a traumatic brain injury (TBI).

According to the lawsuit, it is the mistake in medications that ultimately killed Anglesey. Doctors either did not examine carefully enough, or ignored altogether, the interactions between the numerous drugs prescribed to Anglesey for multiple issues from which he suffered. The official cause of death was mixed drug intoxication and pulmonary embolism, which isn't surprising given the drugs found in his system: 

 

  • Celexa;
  • Morphine;
  • Ambien;
  • Hydromorphone;
  • Promethazine; and
  • Remeron.

 

Prior to filing suit against the VA for medical malpractice, plaintiffs must first file claims with the VA, which was done in this case. The VA then has 6 months to respond to that claim, which they failed to do in this case. Therefore, Anglesey's widow filed a wrongful death lawsuit against the VA in federal court.
