Veteran Sues VA Doctor for Failure to Diagnose


May 26, 2010 - Hundreds of thousands of veterans use the Department of Veterans Affairs (VA) health care system. Those veterans, like any other person seeing a doctor, need to trust they are being given the best possible health care. This isn't always the case.  

John Morgan visited the Hampton, Virginia VA medical center in November of 2008. He went in with what would be later described as symptoms of a stroke by government investigators. Dr. Razaak Eniola was the physician on duty and discharged John from the medical center. John's symptoms included:

  • Slurred speech;
  • Unsteady gait; and
  • Weakness on his left side.

John spent the next day in Sentara Norfolk General Hospital where it was discovered he suffered a stroke. John was hospitalized for 6 days and is now permanently disabled. The VA's Inspector General's Office's investigation that followed established the Hampton Center's fault.

The Hampton VA medical clinic, of course, denied all responsibility. John filed a compensation claim but the VA denied responsibility. The VA claimed Eniola was a contract doctor as opposed to being a VA employee.

John took his only available road: he sued Eniola as well as two companies employing him. Both National Emergency Services, Inc. and NES Government Services, Inc. are named as defendants along with Eniola. Johns $2 million claim is based on the catastrophic injuries he claims Eniola caused by his missed diagnosis and negligence.
