FINDINGS OF FACT AND CONCLUSIONS OF LAW
 

After careful consideration of the entire record, the undersigned makes the following findings: 

1. The claimant was born on July 19, 1998. Therefore, he was a preschooler on August 1, 2001, the alleged onset date, and is currently a school-age child (20 CFR 416.926a(g)(2)). 

2. The claimant has not engaged in substantial gainful activity since August 1, 2001, the alleged onset date (20 CFR 416.924(b) and 416.972). 

3. The claimant has the following severe combination of impairments: speech and language problems and attention deficit hyperactivity disorder (ADHD) (20 CFR 416.924(c)). 

The above combination of impairments causes more than minimal functional limitations. 

4. The claimant does not have an impairment or combination of impairments that meets or medically equals one of the listed impairments in 20 CFR Part 404, Subpart P, Appendix 1 (20 CFR 416.924,416.925 and 416.926). 

5. The claimant has an impairment or combination of impairments that functionally equals the listings (20 CFR 416.924(d) and 416.926a). 

In determining the degree of limitation in each of the six functional domains, the undersigned has considered all symptoms in accordance with the requirements of 20 CFR 416.929 and SSR 967p. The undersigned has also considered the opinion evidence, consistent with 20 CFR 416.927 and SSRs 96-2p, 96-5p, 96-6p and 06-3p. 

The claimant's impairments cause:

  • No limitation in acquiring and using information
  • Marked limitations in attending and completing tasks
  • Marked limitations in interacting and relating to others
  • No limitation in moving about and manipulating objects
  • No limitation in caring for personal needs
  • No limitation in health and physical well-being

At the hearing, the claimant's mother testified that the claimant was going to attend the 3rd grade and should be in the 5th grade. She stated that when the claimant was younger he used his hands and act out to communicate. She stated that claimant was harming himself and his brother. He bites his nails to where he bleeds and has taken a knife out of the kitchen and threatens to kill himself.
