FINDINGS OF FACT AND CONCLUSIONS OF LAW 

After careful consideration of the entire record, the undersigned makes the following findings: 

1. The claimant has not engaged in substantial gainful activity since February 7, 2007, the date the application for supplemental security income was filed (20 CFR 416.920(b) and 416.971 et seq.). 

2. The claimant has the following severe impairment(s): human immunodeficiency virus (HIV) infection and mental disorder (20 CFR 416.920(c)). 

3. The severity of the claimant's human immunodeficiency virus (HIV) infection meets the criteria of section(s) 14.08 N of 20 CFR Part 404, Subpart P, Appendix 1 (20 CFR 416.920(d)). 

In making this finding, the undersigned considered all symptoms and the extent to which these symptoms can reasonably be accepted as consistent with the objective medical evidence and other evidence, based on the requirements of 20 CFR 416.929 and SSRs 96-4p and 96-7p. The undersigned has also considered opinion evidence in accordance with the requirements of 20 CFR416.927 and SSRs 96-2p, 96-5p, 96-6p and 06-3p. 

Medical records from Sheetal Sharma, M.D., dated March 25, 2005 showed that the claimant's CD4 count was 46 and viral load was 354,000. On October 26, 2006, the claimant's CD4 count was 282L. On February 14, 2007, the claimant's CD4 count was 371L and CD4/CD8 ration was 33L. 

Treatment notes from Broward Family Health Center dated August 8, 2006 through February 20, 2007 showed that the claimant has been treated for bacteria, peripheral neuropathy, depression, aids, weakness, leg pain, joint pain, and low CD4 count. 

Treatment records from Raymon Elliot, M.D., dated September 14, 2007 through August 21, 2008 showed that the claimant has undergone numerous office visit notes reflecting regular trips to the doctor to seek relief from the alleged symptoms. 

A GYN pathology specimen dated August 18, 2008 showed low grade Squamous Intraepithelial Lesion encompassing: Human Papilloma Virus (HPV); low grade dysplasia CIN1. 

Laboratory reports dated September 3, 2008 showed that the claimant's CD4 count was .42L.
