FINDINGS OF FACT AND CONCLUSIONS OF LAW
 

After careful consideration of the entire record, the undersigned makes the following findings: 

1. The claimant's date last insured is December 31, 2011. 

2. The claimant has not engaged in substantial gainful activity since November 29, 2006, the alleged onset date (20 CFR 404.1520(b) and 404.1571 et seq.). 

3. The claimant has the following severe impairment(s): multiple sclerosis and migraines (20 CFR 404.1520(c)). 

4. The severity of the claimant's multiple sclerosis meets the criteria of section(s) 11.04 of 20 CFR Part 404, Subpart P, Appendix 1 (20 CFR 404.1520(d)). 

In making this finding, the undersigned considered all symptoms and the extent to which these symptoms can reasonably be accepted as consistent with the objective medical evidence and other evidence, based on the requirements of 20 CFR 404.1529 and SSRs 96-4p and 96-7p. The undersigned has also considered opinion evidence in accordance with the requirements of 20 CFR 404.1527 and SSRs 96-2p, 96~5p, 96-6p and 06-3p.

Listing 11.04 central nervous system vascular accident requires one of the following more than three months post-vascular accident: A. sensory or motor aphasia resulting in ineffective speech or communication; or B. significant and persistent disorganization of motor function in two extremities, resulting in sustained disturbance of gross and dexterous movements, or gait and station. 

Gregory Aslanian M.D. evaluated the claimant originally on November 22, 2006, for complaints of visual changes, asthma, and back problems. On May 14, 2008, Dr. Aslanian reported that the claimant complained of multiple sclerosis, permanent loss of vision, problems with the right eye, skin sensitivity, leg cramps, difficulty sleeping, and poor balance. Dr. Aslanian diagnosed the claimant with possible restless leg syndrome and multiple sclerosis with frequent falls and recommended that the claimant use a cane. 

The claimant was hospitalized on November 29, 2006, for complaints of change in vision, weakness, and lightheadedness. The attending physician, Dr. Aslanian, reported that the claimant had episodes of sudden changes in vision which was described as tunneling that would come and; go, and these episodes were associated with a headache. Dr. Aslanian further reported that the claimant had episodes of double vision which were quite severe, and vertigo associated with nausea and lightheadedness. Dr. Aslanian noted that the claimant had a somewhat ataxic gait and was anxious. Dr. Aslanian diagnosed the claimant with multiple sclerosis and asthma.
