Disabilities: Schizoaffective disorder, borderline intellectual functioning, and a deformity of the left elbow

Notice of Decision: Fully Favorable
Administrative Law Judge: Carol J. Pennock
Office of Disability Adjudication & Review (ODAR): Miami-Dade County & Monroe County: Office of Disability Adjudication & Review (ODAR)

FINDINGS OF FACT AND CONCLUSIONS OF LAW

After careful consideration of the entire record, I make the following findings:

1. The claimant attained age 18 on April 24, 2003 and was eligible for supplemental security income benefits as a child for the month proceeding the month in which he attained age 18. The claimant was notified that he was found no longer disabled as of April 1, 2005, based on a redetermination of disability under the rules for adults who tile new applications.

2. The claimant has the following severe impairments: schizoaffective disorder, borderline intellectual functioning, and a deformity of the left elbow (20 CFR 416.920(c)).

The above impairments cause significant limitation in the claimant's ability to perform basic work activities.

3. The severity of the claimant's schizoaffective disorder meets the criteria of section 12.03 of 20 CFR Part 404, Subpart P, Appendix 1 (20 CFR 416.920(d)).

In making this finding, I considered all symptoms and the extent to which these symptoms can reasonably be accepted as consistent with the objective medical evidence and other evidence, based on the requirements of 20 CFR 416.929 and SSRs 96-4p and 96-7p. I have also considered opinion evidence in accordance with the requirements of20 CFR 416.927 and SSRs 96-2p, 96-5p, 96-6p and 06-3p.
