FINDINGS OF FACT AND CONCLUSIONS OF LAW

After careful consideration of the entire record, the undersigned makes the following findings: 

1. The claimant was born on August 10, 1989 and was therefore in the "Adolescents (age 12 to attainment of age 18)" age group on April 2, 2007, the alleged onset date (e.g., 20 CFR 416.926a(g)(2)(v)). The claimant attained age 18 on August 9, 2007 (20 CFR 416.120(c)(4)). The claimant had not attained age 22 as of April 2, 2007, the date disability is established (20 CFR 404.350(a)(5). 

2. The claimant did not engage in substantial gainful activity prior to attaining age 18 (20 CFR 416.924(b) and 416.972); nor has the claimant engaged in substantial gainful activity since April 2, 2007, the alleged onset date (20 CFR 404.1520(b), 404.1571 et seq., 416.920(b) and 416.971 et seq.). 

3. Before attaining age 18, the claimant had the following severe impairment: Uncontrollable muscle tremors. (20 CFR 416.924(c)).

The above impairment causes more than minimal functional limitations and causes significant limitation in the claimant's ability to perform basic work activities. (20 CFR 404.1520(c) and 416.920(c)). 

4. Before attaining age 18, the claimant did not have an impairment or combination of impairments that met or medically equaled one of the listed impairments in 20 CFR Part 404, Subpart P, Appendix 1 (20 CFR 416.920(d), 416.924, 416.925 and 416.926). Since April 2, 2007, the claimant has not had an impairment or combination of impairments that meets or medically equals one of the listed impairments in 20 CFR Part 404, Subpart P, Appendix 1 (20 CFR 404.1520(d), 416.920(d), 416.925 and 416.926). 

5. Before attaining age 18, the claimant had an impairment or combination of impairments that functionally equaled the listings (20 CFR 416.924(d) and 416.926a). 

In making this finding, the undersigned has considered all symptoms and the extent to which these symptoms can reasonably be accepted as consistent with the objective medical evidence and other evidence, based on the requirements of 20 CFR 416.929 and SSRs 96-4p and 96-7p. 

The undersigned has also considered opinion evidence in accordance with the requirements of 20 CFR 416.927 and SSRs 96-2p, 96-5p, 96-6p and 06-3p.
 

The claimant's impairment causes:

  • no limitation in acquiring and using information
  • marked limitations in attending and completing tasks
  • no limitation in interacting and relating to others
  • less than marked limitations in moving about and manipulating objects
  • less than marked limitations in caring for personal needs
  • marked limitations in health and physical well-being
