    A Hearing was held on July 13, 2004, concerning the claims of increased disability for the metatarsalgia of the right foot currently 10% disabling, and for service connection for low back pain secondary to the foot condition. On July 29, 2004 the RO issued a letter to the veteran that he was granted 10% disability for low back condition with radicular symptoms, secondary to service connected metarsalgia, right foot, assigned from March 8, 2001. The veteran’s combined rating was 20%
  • Court of Appeals for Veterans Claims Brief: BVA Denial of Servie Connection (Brief 1, p 7)   
    On May 2, 2003, the RO issued a Decision on the claim for low back condition secondary to metatarsalgia right foot stating that they had denied the claim since the service medical records did not show treatment or a diagnosed back condition during the veteran’s period of active military service (R. 708-715), and stating that an examiner of March 18, 2002, stated it was unlikely that the veteran’s low back condition was related to the veteran’s service connection right foot metatarsalgia.

    On October 9, 2001, Dr. Peter Gorman of the Dept. Of Veterans Affairs, Maryland Health Care System, wrote that after reviewing the veteran’s medical records dated March 28, 1980 and May 6, 1980, in which the veteran complained of numbness of the toes of the right foot, that based on those two brief encounters during the veteran’s basic training period, it was certainly possible that the symptoms of the 1980’s and the symptoms of the late 1990’s were related.

Read an actual SSDI case where an ALJ decided favorably for our client who suffers from limited use of his left arm, no use of left hand and weakness in his left leg, residual cognitive impairments, bipolar disorder, and claudication in his lower extremities.
  • Bipolar Disorder | Cognitive Disorder | Social Security Disability (Case 60, p.4)   
    Dr. Dahlia V. Gordon, Psy.D diagnosis claimant had Bipolar I Disorder and a Cognitive Disorder was strong evidence in the Administrative Law Judge's (ALJ's) decision. She recommended that the claimant receive increased frequency of psychiatric service with emphasis on reevaluating claimant's current medication regimen and with emphasis on addressing compliance. Also, she recommended claimant participate in psychotherapy in order to monitor her moods and reality testing and also to address claimant's cannabis use.
  • Bipolar Disorder | Cognitive Disorder | Social Security Disability (Case 60, p.3)   
    In March of 2007 our client reported that she has been off of her psychiatric medication and attempted suicide the previous week. A psychiatric report noted that the claimant was lacking in social etiquette. The claimant's attention, concentration, and task persistence and pace were impacted by her borderline cognitive functioning, her low to borderline memory function, and the presence of a mental health disorder.
  • Bipolar Disorder | Cognitive Disorder | Social Security Disability (Case 60, p.2)   
    Our client has not worked since 2007 because she, "just doesn't want to go outside." The claimant also reported that she had a domestic violence charge placed against her about five years ago when she hit her mother with a glass after her mother woke her up from bed.
  • Bipolar Disorder | Cognitive Disorder | Social Security Disability (Case 60, p.1)   
    Our client was seen on an emergency basis at Henderson in March of 2007 after she overdosed on aspirin the previous week. The claimant's mother, with whom claimant lives, testified that the claimant left a suicide note to her son telling him the trees were telling her what to do.
  • Chronic Obstructive Pulmonary Disease | AIDS | Neuropathy | Fatigue | Shortness of Breath | Social Security Disability (Case 59, p.3)   
    In June 2008, our client was diagnosed with AIDS, acute bronchitis and peripheral neuropathy. By October 2008 the diagnosis included COPD. His treating physician completed a Residual Functional Capacity Form on 06/06/08, stating that the claimant, due to his diagnosis of HIV, with symptoms of dizziness, and fatigue, would need to sit for about 5 hours per day in a recliner or recline in a bed.
  • Chronic Obstructive Pulmonary Disease | AIDS | Neuropathy | Fatigue | Shortness of Breath | Social Security (Case 59, p.1)   
    Our client's treating physician completed a Residual Functional Capacity Form stating that the claimant, due to his diagnosis of HIV, with symptoms of dizziness, and fatigue, would need to sit for about 5 hours per day in a recliner or recline in a bed. Claimant was able to sit, stand, or walk for less than 2 hours each in an 8-hour workday; and would be absent from work more than four days a month due to his impairments or treatments.
  • Hypertension | Epilepsy / Seizure Disorders | Anxiety | Depression | Social Security Disability (Case 58, p.1)   
    Our client's impairments met Social Security Disability Listing 11.02. Per her credible testimony as corroborated by the totality of the medical evidence now of record and by the Medical Expert's opinion, she was diagnosed with grand mal seizure attacks. She also suffers from anemia and repeated seizure attacks not relenting in spite of medication treatments.
  • Hypertension | Diabetes Mellitus | Social Security Disability (Case 57, p.1)   
    The medical evidence of record showed that our client had been treated and followed for hypertension and diabetes mellitus since January 2003. At the hearing, the Administrative Law Judge (ALJ) observed the claimant to be extremely short of breath. Her shortness of breath was such that the ALJ determined that our client can do no more than light work activity.

    The administrative law judge (ALJ) considered the claimant's age, education, work experience, and residual functional capacity, and determined that there are no jobs that exist in significant numbers in the national economy that the claimant can perform.

    In a statement dated July 7, 2006, Melvyn Rech, D.O., expressed the opinion that the claimant could sit for less than two hours, stand for about two hours in an eight hour workday. She would need a job which permitted shifting positions at will from sitting, standing or walking, and she would need to take unscheduled breaks. She could lift up to ten pounds occasionally, but she cannot stoop or crouch, according to Dr. Rech. The Administrative Law Judge gave controlling weight to the opinion of Dr. Rech, because he treated the claimant since January 26, 2006 and his opinion is well supported.
  • Degenerative Disc Disease | Hip Bursitis | Osteoarthritis of the Lumbar Spine | Social Security Disability (Case 56, p.1)   
    During an examination on May 24, 2005, the claimant complained of pain in the back and left hip. She reported she was unable to stand for long periods of time, bend, stoop, or squat. The doctor observed that the claimant was very stiff on range of motion and she walked with a slight limp. X-ray of the lumbar spine indicated severe degenerative disc disease.
  • Epilepsy Seizure Disorder | Mini Strokes | Vertigo | Hypertension | Social Security Disability (Case 55, p.4)   
    After considering the evidence of record, the administrative law judge (ALJ) found that our client's medically determinable impairments could reasonably be expected to produce the alleged symptoms and that our client's statements concerning the intensity, persistence and limiting effects of these symptoms are generally credible.
  • Epilepsy Seizure Disorder | Mini Strokes | Vertigo | Hypertension | Social Security Disability (Case 55, p.3)   
    The claimant testified that even though she takes medication, she still experience the partial seizures at any time. The claimant stated that when she has the partial seizures, she would stare, fall. Moreover, she testified that she experience dizziness 1 to 3 times a week, and would see double, as well as stagger. Furthermore, the claimant testified that she has fatigue and feels tired.
  • Epilepsy Seizure Disorder | Mini Strokes | Vertigo | Hypertension | Social Security Disability (Case 55, p.2)   
    A thorough review of the claimant's medical evidence of record relates that the claimant was involved in a car accident in March 2007, and suffered some bleeding in the brain which caused difficulty with memory. The documentary evidence of record also shows that the claimant experienced a stroke and as a result, she experiences seizures and headaches.
  • Epilepsy Seizure Disorder | Mini Strokes | Vertigo | Hypertension | Social Security Disability (Case 55, p.1)   
    At the hearing, our client testified that she is homeless. She related that she experiences seizures maybe 1 or 2 times a week. She also indicated that she takes high blood pressure medication. Additionally, our client reported that in 2007, she had a stroke, and as a result; she experiences migraine headaches almost every night. She related that she also demonstrated grand mal seizures.
  • Osteoarthritis | Hypertension | Obesity | Social Security Disability (Case 54, p.2)   
    Our client's orthopedist noted in February 2008 that her left knee pain was worsening, particularly with standing and walking and that she had difficulty sleeping due to pain. She had to use a cane to ambulate. Her physical examination demonstrated swelling, valgus deformity, and crepitance with range of motion. She was assessed with advanced osteoarthritis of the left knee.
  • Osteoarthritis | Hypertension | Obesity | Social Security Disability (Case 54, p.4)   
    The claimant's obesity, in combination with her end stage osteoarthritis, is likely a factor contributing to her limited ability to stand and walk or perform postural functions as the result of her valgus deformity, crepitance, and swelling, which in turn impacts her ability to climb, balance, stoop, kneel, and crouch and requires her to use a cane for ambulation.
  • Osteoarthritis | Hypertension | Obesity | Social Security Disability (Case 54, p.3)   
    When our client was examined by a consultative physician in March 2007, there was evidence of positive swelling and tenderness of the left knee and valgus deformity on the left. The claimant's reflexes were normal, but she was ambulatory without assistance for only a few steps, and her gait was unstable and antalgic. She was unable to perform tandem walk, heel to toe walking, or partial squatting
  • Osteoarthritis | Hypertension | Obesity | Social Security Disability (Case 54, p.1)   
    Our client has the following severe impairments: severe osteoarthritis of the bilateral knees, hypertension, status post left ankle fracture, and obesity. The claimant testified that her condition has progressed and is getting worse all the time. After considering the evidence of record, the ALJ found that the claimant's medically determinable impairment could reasonably be expected to produce the alleged symptoms and that the claimant's statements concerning the intensity, persistence and limiting effects of these symptoms are generally credible.

Petitions:

  • Florida: Free Access to Medical Records for the Disabled   
    Florida statute 395.3025 states that individuals requesting medical records may be charged up to $1 per page for copying their medical records. The issue with the statute is that people applying for Veterans’ Disability Compensation, Social Security Disability/SSI, or Medicaid generally cannot afford copies of their medical records to prove their disability and receive federally funded benefits.

    We cannot describe how frustrating it is to be contacted by a disabled individual who appeared at their Social Security hearing, but were still denied because they could not afford the necessary medical records to prove their disability case. Please join us in fighting to amend this statue - sign our petition today!

  • Epilepsy Foundation of Florida   
    The Epilepsy Foundation of Florida is a non-profit organization working to help these suffering from epilepsy in Florida. Their website offers support and information useful to those with the seizure disorder and their families. The Foundation has recently be working to help veterans with epilepsy.
  • The American Veterans Disabled for Live Memorial   
    The American Veterans Disabled for Life Memorial is a non-profit organization that is working to erect a monument to all disabled U.S. service men and women. The tribute will be built in Washington D.C. and will feature a star shaped reflecting pool and eternal flame. Please read on to learn more about the organization and monument.
  • Wheelchairs for Warriors   
    Wheelchairs for Warriors is a Florida based disabled veterans assistance group that gives severely disabled veterans the chance to participate in a marathon. Volunteers run with the veterans, pushing them toward the finish line and a sense of accomplishment. When the marathon is over the veterans are given a custom wheelchair courtesy of the organization and its sponsors.
  • VetWalking.org   
    Richard Hunsucker wanted to bring attention to the special needs of disabled American veterans. To do so Hunsucker formed the non-profit organization Vet Walking. Starting in Jacksonville, Florida Hunsucker began walking across the country in order to raise money and awareness for disabled veterans.   • Homes for Our Troops (HFOT)   
    Homes for Our Troops is a nonprofit organization that works to provide disabled veterans with specially adapted homes. The group has completed 51 homes to date, all of which now house veterans who were injured in the Iraq or Afghanistan wars and their families. The homes feature adaptations such as wheelchair accessible showers and cook tops along with wheelchair ramps and wider doorways.   • Stand Down | National Coalition for Homeless Veterans   
    Stand Down is a movement that gives homeless veterans much needed supplies and services. The events take place across the country and are organized by the National Coalition for Homeless Veterans. Read on to learn more about the events and the history of Stand Down.
  • The Center for Drug-Free Living   
    The Center for Drug-Free Living has been operating in Florida for over 35 years.
