Defining Social Security Disability Insurance (Part B)

Not everyone is fortunate enough to have uninterrupted employment. Even if you've been unemployed off and on, you can still receive SSDI benefits if you did work for a total of 5 of the past 10 years. The SSA issues every worker a statement of their FICA contributions each year. This document will tell you whether you have paid enough taxes to qualify for benefits, should you meet the remaining eligibility criteria.

Who Decides If I Am Eligible?

The approval and payment of SSDI benefits is handled by the
Social Security Administration. Local federal field offices process applications and verify their information. Afterwards, a state disability determination service (DDS) will make a ruling on your disability case. If you are denied benefits, you can hire an attorney to help you resubmit your application or appeal your SSDI claim.

Some of the individuals who may contribute to determining your SSDI eligibility are:

  • SSA field office representatives
  • DDS evaluators
  • Your treating physician or psychologist
  • Medical practitioner chosen by the DDS
  • Medical experts and specialists
  • Administrative law judge
  • District court judge
  • Supreme court judge

After the application information is verified, your claim is reviewed by a DDS evaluator, who will gather and request medical evidence from your doctor and other medical professionals, if necessary. They compare your level of disability to the legal definition of disability and the listing for covered impairments, such as blindness. You should have a decision within a couple months after you apply.

If your benefits are denied, you may request a reevaluation from the SSA. A second denial gains you a change of venue, and you may appeal the decision through the Office of Disability Adjudication and Review (ODAR).
