Respiratory disorders, like other impairments, must have medical evidence that supports the need for disability benefits. The severity of the condition will then be evaluated by the Social Security Administration and a determination will be made as to eligibility.
Part of this determination includes finding your ailment on the Social Security Administration's listing of impairments, which details what conditions may qualify for disability benefits.
Category of Impairments - Respiratory System
The listing of impairments for the respiratory system is as follows:
If you or someone you love suffers from any of these conditions, you may qualify for Social Security disability benefits. Each listing has specific criteria that must be met in order for a claimant to qualify.
Substantial Gainful Activity
A person must be unable to engage in Substantial Gainful Activity (SGA) in order to qualify for disability benefits. A claimant's ability to collect Social Security disability benefits will be dependent on their participation in SGA.
This determination is made based on how much you earn monthly. If you are earning more than a certain monthly amount, which is your "net of impairment-related work expenses," you may be considered to be engaging in SGA which would disqualify you for disability benefits.
Currently, the monthly amounts for 2010 are: $1,640 if you are statutorily blind and $1,000 if you are not blind. A lower amount is specified by Federal regulations to those individuals who are not blind. When the national average wage index increases, then generally both amounts will also increase.
In addition, these amounts do not apply to Social Security Income (SSI) benefits if you are blind; however, if you are non-blind, they do apply.
