When Car “Accidents” Are Someone’s Fault (Part B)

If you have been injured in a car accident caused by another driver's negligence, you shouldn't suffer.

It is illegal or constitutes reckless driving in Florida and other states to:
  • Wear a music headset or other listening device while driving
  • Operate a motor vehicle with greater than 0.08 percent blood alcohol concentration
  • Speed in excess of safe conditions
  • Drive into an oncoming lane
  • Race vehicles on public roads
  • Operate a commercial vehicle for longer than federal motor carrier safety regulations allow

Some conditions that can impair a driver's judgment and reaction time include driving while fatigued, on medication, and using a cellular phone. People make a serious choice when they get behind the wheel of a car, and a judge and jury may consider being overtired, taking certain drugs or simply concentrating on something other than driving gross negligence. The fact is that drowsy, reckless and careless driving cause serious accident injuries and fatalities every day.

If You Suspect Negligence in Your Car Accident

Even though you were injured, you may have gotten a good look at the driver who caused your auto accident. If you noticed any wardrobe or accessories that could have prevented a driver seeing or hearing your vehicle coming, make a note of them. A driver's physical appearance will reveal fatigue, alcohol or drug impairment. Some of this information may have been recorded by police. Discuss any evidence with your accident attorney.

If you do have a solid case, you must file a claim in civil court within four years of the accident date. You may be able to name the driver, the owner of the car (if different from operator) and/or a motor carrier company in a lawsuit.

You can seek monetary damages for:
  • Your physical pain and mental suffering
  • Your current and future medical expenses
  • Hospital or rehabilitation stays
  • Wages lost while you are disabled

Your attorney may use testimony from those at the accident scene or expert field witnesses to assess your injuries and corroborate your charges of negligence. A successful lawsuit will end in a settlement that will help you get back on your feet.

When you are interviewing personal injury attorneys ask critical questions, like: how long have you been practicing; what is the largest settlement or verdict you've obtained, and do you have experience with accident injuries? The Law Offices of LaVan & Neidenberg, located in Fort Lauderdale, Florida takes time when speaking with you about your case and works with you on a contingent fee basis so there are NO FEES unless our trained personal injury lawyers win your case.
