CRSC: Combat Related Special Circumstance and Disability Compensation

There are many types of benefits and compensation available to disabled veterans after they have served our country. While almost every veteran is entitled to retirement pay, there are other types of benefits that come under special circumstances. Disability benefits are common for injured veterans, but they can often reduce retirement pay amounts. However, there is a way to offset this deduction through CRSC – Combat Related Special Compensation.

The Impact of Disability Benefits on Retirement Compensation

When filing for disability benefits through the VA, you should work with a veterans' disability lawyer in Fort Lauderdale to make sure you are getting rightful compensation. Many veterans do not realize that when they are approved for disability, their retirement pay is often reduced. Your veterans' disability lawyer in Fort Lauderdale can help you seek CRSC to offset this reduction so you may receive the full amounts of both retirement pay and disability benefits.

Retirement pay and disability benefits are handled through the Department of Veterans Affairs. When veterans are awarded both types of compensation, they may not receive the full amounts. The CRSC program is designed to make up this difference, but it does have specific criteria to meet, and you must apply for it through your military branch – NOT the VA.

Criteria for Eligibility and Applying for CRSC

To qualify, you must meet the following criteria:

  • be active, reserve with 20 years of creditable service or medically retired under Chapter 61 with less than 20 years' service;
  • collect military retirement pay;
  • have a 10% or higher disability rating through the VA; and
  • have reduced retirement pay due to your disability benefits.

Other major criteria are to show evidence that your disabling injury resulted during one of the following:

  • combat education that simulates war (drills, field training, etc.);
  • hazardous duty (parachute duty, diving, etc.);
  • armed conflict; or
  • an instrumentality of war (combat vehicle hazards, chemical exposure, etc.).

By working with a veterans' disability lawyer in Fort Lauderdale, you can review your situation to determine if you meet the eligibility to apply. Once you have gathered your evidence of your service and disability injury, you must apply directly through your military branch.

Each branch has its own department to handle these claims. Most run them through a disability or benefits division, while others handle them through a human resources department. Your lawyer may be able to help you go through the application process much quicker than if you attempt to file on your own.
