Veterans' Disability

Veterans who have served our country should be treated with the honor and respect they deserve. If you believe you have a service-connected physical or psychological injury you may be entitled to Veterans’ Compensation.

The disability process is confusing and challenging. It starts with an in-depth application process and is followed by complex appeals. Even after you have received a service-connected disability, the reward system is inconsistent and there is a large disparity in disability ratings. The U.S. Congress has described the process of securing Veterans’ Disability as “confusing,” “inconsistent,” “unfair,” and “unjust.”

At LaVan and Neidenberg, we are determined to secure veterans their rightful disability compensation and disability rating. Whether you are applying for compensation, seeking an increased rating, or appealing a denied request, we are determined to help you.

Soldiers can return from action with a number of conditions, injuries, and aggravated preexisting conditions. According to Veteran’s Affairs (VA), 60,000 U.S. service personnel have been wounded or have struggled with psychological disorders in the wake of their tours in Iraq since 2003. The percentage of amputees is the highest since the Civil War and the VA estimates that up to one-third of all those who have served in Iraq suffer from Post-Traumatic Stress Disorder (PTSD). Equally as important are all the veterans who have served our country regardless of when and where.

If you have a current diagnoses that is the result of a service-connected injury, condition, or illness, you may be eligible for veterans’ disability benefits. You may also receive additional compensation if you were a:

  • Prisoner of War (POW) for any length of time, you may be eligible for disability benefits for psychosis, anxiety issues, dysthymic disorders, frostbite residuals, post-traumatic osteoarthritis, heart disease, hypertensive vascular disease, and strokes.
  • Prisoner of War (POW) for at least 30 days, you may be eligible for disability benefits for avitaminosis, peripheral neuropathy, beriberi, chronic dysentery, helminthiasis, malnutrition (including optic atrophy), pellagra, nutritional deficiencies, irritable bowel syndrome, peptic ulcer disease, and cirrhosis of the liver.
  • Gulf War Veteran, you may be eligible for disability benefits for unexplained multi-symptom illnesses, fatigue, skin disorders, headaches, muscle pain, joint pain, neurological symptoms, neuropsychological symptoms, symptoms involving the respiratory system, sleep disturbances, gastrointestinal symptoms, cardiovascular symptoms, abnormal weight loss and menstrual disorders.
  • Exposed to radiation or radiation during active duty, you may be eligible for disability benefits for most forms of leukemia, and most forms of cancer.
